Should your hire extend well beyond the week, then we offer a four week hire at a price based upon 3.5 times the weekly cost. Thereafter you must raise a further contract as billing will take place for the four weeks.

The contents page ( Hire Products ) shows our nine sections which are each devoted to particular groups of equipment. Within those main sections a breakdown in sub sections further identifies devices of a kind.

At the start of each section nearly a full page is devoted to "content consideration" ( see about xxx ). This is really to help newcomers to EMC testing. We hope you will find it helpful. It has lots of useful pointers when it comes to choosing and then ordering, especially when seeking compatibility amongst the items you are having.

If you have any queries, need assistance or technical help, our friendly team will be willing to help you. If we are short in manpower or just tied up on other calls we'll get back to you.

You will also find that we offer automated forms of measurement under software control. The software was written in-house and has over ten years development behind it. It is also marketed as a saleable product. We hire the software pre-loaded on some rather smart 14" laptops with a GPIB ready to run. This avoids all the headaches of configuring packages on your own PC, and gives us product security.

PROCEDURES AND TERMS OF HIRING
From 1st March 2008

PLEASE READ THOROUGHLY

Procedures

1. Please phone to check the availability of all items required before placing any orders with us..

2. Please allow at least 48 hours notice of requirement if possible, especially when you require us to deliver.

3. Health and safety is an important issue. Where microwave power amplifiers are concerned we will be seeking assurance that the named end user is competent and understands the dangers when using such equipment. Please remember that all unlicensed transmissions are against the law and come under the DTI Radio Investigations Branch.

4. On “Two Day” hires especially, it would be preferred for the customer to personally collect from and return to EMC Hire themselves whenever possible. Otherwise, delivery and return charges can sometimes outweigh the hire charges.

5. Please decide any any accessories required, i.e., coaxial cables, adaptors, loads, attenuators and tripods etc. These are now found under Sections 700, 600 and 800 respectively.

6. Reservation of equipment by telephone is only valid for twenty-four hours & must be confirmed in writing on company headed paper within this period.

7. Although we appreciate your custom please be considerate enough to bear in mind that other customers may have booked the equipment following on from your hire. By retaining equipment without extending the hire period in the proper manner, could cause disappointment to other customers. We also require time to test and check out returned equipment.

8. In the event of dissatisfaction/malfunction, please call us immediately so that the matter can be attended to. We are unsympathetic to claims of inoperable equipment at the end of the hire period for obvious reasons.


Terms

Hire of equipment is subject to the following terms of business which may not be varied without our written consent.


Health & Safety

1.Health and safety is an important issue. Where microwave amplifiers are concerned we will be seeking assurance that the named end user is competent and understands the dangers when using such equipment.

2.The equipment must only be used by a properly qualified operator in accordance with the manufacturers published specification and any appropriate health & safety regulations.

3.Where knowledge of the equipment in operation is in doubt, please make this known to us. In some cases we can arrange for an engineer to deliver and instruct on set up. Engineers can remain on site for a period to oversee the complete operation of the equipment. Charges for this will be by arrangement.

4.New customer’s orders must be accompanied by payment in advance unless references have been agreed. Please allow 4 working days for clearance of cheque. We are likely to vet new customers via the web. We can accept the following credit cards:- Visa, Mastercard, JCB, American Express and Switch - just phone through your card details. EMC Hire imposes a 1% surcharge on transactions over £500 to cover transactional costs.


Period of Hire

There is no minimum hire period but a maximum period of 4 weeks under the first contract. A fresh order must then be raised beyond that initial period. When extending for a longer period than initially agreed a fresh application must be made at least 24 hours before the current period of hire has lapsed and a new purchase orer must be raised to maintain the insurance cover. Retention of equipment beyond the agreed hire period is not permitted and will result in an additional administration period charge.

The hire period will start with delivery of the equipment a.m (if possible on the first day). If we are providing transport the equipment will be picked up on the third day or as agreed between us. If you are dealing with transport the equipment must be returned to us by the end of the hire period.

For weekend hire, Saturday and Sunday are considered as normal working days.

We retain ownership of the equipment at all times and accordingly you must not sell, assign, lease, hire or otherwise dispose of the equipment. You must ensure that the equipment is covered by insurance to the value stipulated in the catalogue and our interest noted on the policy both whilst on your premises and whilst being moved by your transport whether by a Company or private vehicle. A valuation has been assigned in relation to each item reflecting replacement and consequential costs.

The amount of the hire charges will be in accordance with our current catalogue. Prices are subject to change without notice. Payment of all hire charges including delivery charges is strictly nett within thirty days of the date of invoice. Where an invoice is outstanding over 30 days we reserve the right to refuse any new or further period of hire until payment is made in full and statutory interest may be charged. We wish to draw your attention to “ The late Payment of Commercial Debts interest Act 1998”. We are currently entitled to 8% above the rate set by the Governor of the Bank of England.


Delivery and Return

We encourage you personally collect and return hire equipment. You must not use a carrier without our written consent. When returning equipment you are required to use our existing customized packaging. If carriers are used we will arrange pick-up with our own carriers.

When we are delivering the equipment we will generally use our own transport thereby ensuring reliability of the equipment on arrival. There is a minimum charge of £20.00 for delivery, although delivery charges will depend on distance and load. We will only use an external carrier where it is not viable to use our own transport.

When we are requested to arrange collection of hire equipment, the customer MUST notify us 24 hours prior to the termination of hire to enable a collection vehicle to be organised. Our driver will endeavor to visually check the boxes before departing but the equipment will not be formally checked or tested until it is returned to our premises.Please use the yellow “fax back” form to let us know & prepare for pick-up.

Equipment MUST NOT LEAVE THE UNITED KINGDOM without prior written permission. Names of end users and locations must be provided. Hire will be deemed to run from delivery time to return time, regardless of shipping and customs hold ups. We reserve the right to refuse hiring if we feel security and care and safety cannot be assured. Customers will be required to provide proof of insurance cover for operation of equipment outside the United Kingdom.

Damage, as a result of technical misuse or negligence, will be assessed and charged for. We endeavor to inform customers immediately we notice damage with a follow-up when the damage has been fully assessed.


Liability

Whilst we endeavor to give sensible and practical advice concerning the equipment available for hire if you are not a consumer and are acting in the course of a business it is your responsibility to make the correct choice of equipment and to ascertain its suitability for the purpose required.

Whilst we endeavor to transport equipment in working order for immediate use mishaps can occur in transit. In the event of malfunction you must notify us immediately by telephone or fax and we will try to replace the item as soon as possible.

We are sorry but we cannot accept any financial liability for any inconvenience or consequential loss of time or money incurred by the customer although we are happy to refund the hire and delivery charges where we have been unable to perform the contract or to make an allowance against such charges where there has been delay on our part or malfunction of the equipment.

We do not accept liability for any failure or delay in performance of this agreement which is caused by circumstances beyond our reasonable control.

You will be solely responsible for and will fully indemnify us against any liability for loss or injury whatsoever (including death) to persons or property occurring in connection with any use of the equipment .


Cancellation

If, after placing an order for hire of equipment you then cancel the order or part of the order we reserve the right to charge either in full the value of the hire agreement including delivery charges or part thereof taking into account the amount of notice given and our ability to re-hire the equipment for the hire period.

If you are a customer i.e., acting for purposes outside the normal course of your business and the hire agreement is concluded by means of distance communication e.g., fax, telephone etc then you may have a right to cancel this contract under the Consumer Protection (Distance Selling) Regulations 2000 except where the hire equipment has already been delivered to you or collected by you.


Termination

If you commit any breach of the terms of business we may terminate the contract of hire immediately and require payment of all hire and delivery charges.

If you become insolvent we reserve the right to terminate the contract immediately and require payment of all hire and delivery charges.


Third Party Rights

For the purposes of the Contracts (Rights of Third Parties) Act 1999 this Agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.


English Law

This agreement shall be governed by and construed in accordance with the law of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
